Nichol vs. Nichol

This is an action brought in the surrogate court of the County of Norfolk, by Jane Nichol, widow of Geo. Nichol, deceased, late of the township of South Walsingham, in the County of Norfolk, farmer, deceased, to establish a will said to have been made by the said George Nichol in his lifetime wherein it is said he devised all his property to his widow.

The deceased, it is said, left property amounting to $20,000. The will was objected to by James Nichol, of Buffalo, a brother of the deceased.

After hearing the evidence adduced, Judge Robb gave judgment upholding the will.

Fifty witnesses were present for both sides.

Mr. T. R. Slaght, K.C., and Mr. J. Carruthers acted for the plaintiff. Mr. H. P. Innes, K.C., and Mr. John Porter were counsel for defendant.

It is understood that the judgment of Judge Robb will be appealed.
